Terms of Service

By accessing or using a covered service, you agree to these Terms. If you use the service for an organization, you confirm that you have authority to accept these Terms for that organization; in that case, “you” and “Customer” refer to the organization.

An order form, enterprise agreement, data-processing addendum, or other written agreement signed by MoleSignal and Customer takes priority if it conflicts with these Terms. Source code and self-hosted components are governed by their applicable open-source or commercial license terms rather than these hosted-service Terms.

You must be legally able to enter this agreement and must provide accurate account information. You are responsible for activity under your credentials, for keeping authentication methods secure, and for notifying MoleSignal promptly about suspected compromise or unauthorized access.

Workspace owners and administrators may invite or remove users, assign permissions, configure retention and integrations, access Customer Data, and otherwise control the workspace. Customer is responsible for its administrators, users, and the instructions they give through the service.

Subject to these Terms and payment of applicable fees, MoleSignal grants Customer a limited, non-exclusive, non-transferable right during the subscription term to access and use the hosted service for its internal business and observability purposes.

This right does not permit resale, unauthorized sublicensing, creation of a competing service from protected portions of MoleSignal, circumvention of usage limits, or access to non-public systems except through interfaces and documentation MoleSignal makes available.

Customer retains its rights in logs, metrics, traces, profiles, user-experience data, configurations, dashboards, queries, files, and other content submitted to the service (“Customer Data”). Customer gives MoleSignal permission to host, copy, process, transmit, display, and create technical transformations of Customer Data only as needed to provide, secure, support, and improve the contracted service or as otherwise instructed in writing.

Customer is responsible for deciding what data to collect, establishing a lawful basis, giving required notices, obtaining necessary permissions, and configuring access, masking, sampling, and retention. Customer must not submit data that the service is not designed or contractually approved to handle.

MoleSignal does not become the owner of Customer Data. Customer should maintain appropriate source-system backups and should export information it needs before a subscription ends, subject to the export capabilities and retention period of its plan.

You may not use the service, or help another person use it, to:

The service may connect to identity providers, cloud platforms, notification tools, data sources, and other third-party products. Customer decides whether to enable an integration and authorizes MoleSignal to exchange the data needed to operate it.

Third-party products are controlled by their providers and may have separate terms, privacy practices, availability, and fees. MoleSignal is not responsible for a third-party product merely because the service can connect to it.

MoleSignal may update the service to improve security, reliability, usability, or functionality. We may add, modify, or retire features, but will use reasonable efforts to give advance notice when a material change removes core paid functionality during a current subscription term.

Maintenance, emergencies, upstream provider failures, internet conditions, and events outside reasonable control can affect availability. Current operational information is published on the MoleSignal status page when practical. Any service-level commitment applies only if stated in a separate written agreement.

Preview, beta, experimental, or evaluation features may change or end at any time and may be subject to lower support, security, retention, or availability commitments. They should not be used for production-critical workloads unless the applicable documentation says otherwise.

Fees, usage allowances, billing periods, renewal terms, and payment dates are stated in the applicable plan, checkout flow, or order form. Unless that document says otherwise, fees are non-refundable except where law requires a refund, and Customer is responsible for taxes other than taxes based on MoleSignal's net income.

MoleSignal may change public pricing for a future renewal or new purchase by giving reasonable notice. Overdue undisputed amounts may result in interest, restricted functionality, or suspension after notice where notice is practical.

MoleSignal and its licensors retain all rights in the hosted service, documentation, branding, designs, and technology, excluding Customer Data and third-party materials. No right is granted except the limited right expressly stated in these Terms or another written agreement.

If you provide product suggestions or feedback, you allow MoleSignal to use it without restriction or payment, but we will not identify you publicly as the source without permission.

Open-source components remain subject to their own licenses. If an open-source license grants a right that conflicts with these Terms for that component, the open-source license controls for that component.

Each party may receive non-public information that a reasonable person would understand to be confidential. The receiving party will use it only to perform or exercise rights under the service relationship and will protect it with at least reasonable care.

Confidential information does not include information lawfully known without restriction, independently developed, publicly available without breach, or rightfully received from another source. A legally compelled disclosure is permitted if the receiving party gives notice when lawful and reasonably cooperates in seeking protection.

MoleSignal may limit or suspend access when reasonably necessary to address a security threat, unlawful use, material breach, risk to other customers, or overdue undisputed payment. When practical, we will notify Customer and allow a reasonable opportunity to correct the issue.

Either party may terminate as allowed by the applicable plan or written agreement. MoleSignal may terminate for an uncured material breach or if continuing the service would violate law. Customer remains responsible for charges incurred before termination.

After termination, access ends and Customer Data is deleted according to the applicable retention process, except for limited backups and records that must be retained for security, billing, dispute, or legal reasons. Terms that by their nature should continue—including ownership, confidentiality, disclaimers, liability limits, and general terms—survive.

MoleSignal will provide the paid hosted service with reasonable care and skill and will use commercially reasonable efforts to maintain the security and availability commitments stated in any applicable written agreement.

Except for express promises in these Terms or another signed agreement, and to the extent law permits, the service is provided as available. MoleSignal disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any guarantee that the service will be uninterrupted, error-free, or suitable as the sole repository for Customer Data.

To the extent law permits, neither party is liable under these Terms for indirect, incidental, special, exemplary, punitive, or consequential loss, or for lost profits, revenue, goodwill, or data, even if informed that the loss was possible.

To the extent law permits, each party's total liability arising from the hosted service will not exceed the fees paid or payable for the affected service during the twelve months before the event giving rise to the claim. If no fee was payable, the total limit is US$100.

A limitation does not apply where it is prohibited by law. A signed service agreement may set different limits, and those negotiated limits control. Nothing in these Terms limits payment obligations or liability that cannot legally be limited, including liability arising from fraud or intentional misconduct.

Neither party may assign these Terms without the other's consent, except in connection with a merger, reorganization, sale of substantially all relevant assets, or transfer to an affiliate that can perform the obligations. Neither party is responsible for delay caused by events beyond reasonable control, except payment obligations.

If part of these Terms is unenforceable, it will be adjusted only as much as necessary and the remaining terms continue. A waiver must be clear and does not waive a later breach. These Terms do not create a partnership, agency, employment relationship, or third-party beneficiary right.

The governing law, courts, and dispute process stated in an order form or signed service agreement control. If none is stated, the law and competent courts of the MoleSignal service operator's principal place of business apply, without regard to conflict-of-law rules.

MoleSignal may update these Terms for future use of the service. We will revise the effective date and provide reasonable notice of a material change. A change will not retroactively reduce a negotiated commitment for a current paid term unless required by law or agreed by Customer. Continued use after the stated effective date means the updated Terms apply.
